Booking Terms and Conditions

Read this agreement thoroughly and carefully before booking a trip with us.

Agreement: The terms and conditions set forth in this agreement constitute the entire understanding and agreement between you the trip “Participant” and AMAZON EMOTIONS “AE” with respect to any and all bookings, tours or transactions made with AMAZON EMOTIONS. By submitting a booking form and signing this agreement, you accept all of the terms in this agreement and direct us to perform services on your behalf.

TERMS DEFINED

Adventure Specialist: refers to AE sales personnel who assist Guests in the planning and booking of their Trips.

Tailor-Made Amazon Tours: refers to Trips that are individually designed and organized for private groups of Guests.

Expedition Leader: refers to the individual(s) guiding an AE Trip, responsible for leading the Trip and overseeing the day-to-day activities on the Trip.

Extensions: refers to pre- or post-Trip experiences arranged by AE that typically include accommodations, transportation and/or group activities.

Guest: refers to any individual(s) booked on and participating in an AE Trip.

Local Guide: refers to guide(s) who assist in the specific country(ies)/locations included in the Trip.

Amazon Emotions (“AE,” “us,” or “we”): refers to Amazon Emotions – ME, its parent, subsidiaries, and their respective employees, affiliates, officers, directors, successors, representatives and assigns.

Physical Requirements: refers to the physical expectations required of Guests as a condition of participation in a Trip.

Private Trips: refers to Trips that are booked and operated exclusively for a particular Guest or group of Guests.

Tour Operator: refers to any vendor responsible for organizing and operating AE Trips.

Trip: refers to the specific Trip arranged and organized by AE in which the Guest is participating.

Exploratory Trips: refers to inaugural “trial” Trips to new destinations for a select small group of Guests.

Extensions: refers to pre- or post-trip experiences arranged by AE that typically include accommodations, transportation and/or group activities.

TO BOOK YOUR ECOTOUR

  1. All reservations must be made with email confirmation.
    A non-refundable 15% deposit must be made at the time of booking and full payment must be made 60 days prior to arrival unless requested at an earlier date by Amazon Emotions. Your deposit can be made by Visa, MasterCard, Discover or American Express through PayPal or wire transfer. All prices are in Brazilian Reais. Failure or late payment will result in cancellation of the reservation. When requesting a reservation, we will accept the terms set out in this document, and allow Amazon Emotions to perform its services for participants during the reservation dates. All participants are bound by the terms of this document and are aware of these terms.
  2. Receive Confirmation
    Upon booking, you will receive confirmation by email and a comprehensive electronic Pre-Departure Briefing with details about your trip, destination, the history and wildlife of the region, what to pack, and how best to prepare.
  3. Trip Forms
    To enhance our service for our guests and to reduce paper waste, Amazon Emotions provides all forms online with essential information requested for the trip, including: names of participants, date of birth, nationality, languages ​​spoken, medical restrictions, food restrictions and preferences, allergies, special interests, programming options and any other information that may contribute to better assisting in the experience of our participants. Links to these forms will be sent by email. These forms must be submitted online within 7 days of booking.

TRIP INCLUSIONS

Each itinerary includes a variety of features and elements unique to that specific adventure. Please consult the individual trip pages on our website for a full list of inclusions and exclusions for the trip of your choice.

TRIP CANCELLATION AND REFUND POLICY

To cancel a reservation, the request must be sent by email. There will be no refund for the 15% booking deposit. Cancellation fees will apply according to the terms below, based on the date we receive the cancellation request:

• Between 59 and 45 days prior to arrival, Amazon Emotions will refund 70% of the payment.
• Between 44 and 30 days prior to arrival, Amazon Emotions will refund 30% of the payment.
• After 29 days prior to arrival there will be no refund.
• Also, there will be no refund in case of early departure.
• In case of refunds, a 5% charge will be applied for credit card payments. There is no fee for bank payment or bank payment slip.

REMARKS

We want to help our visitors plan their trip to Amazon Emotions with confidence, and we have several ways to contribute, offering greater flexibility for rebooking:

• Reservations can be rescheduled without penalty up to 7 days before check-in. For a rebooking between 6 and 0 days before check-in, 100% of the accommodation will be charged.
• Reservations can be rebooked twice, with check-out by December 18, 2023.
• Reservations are personal and non-transferable.
• In case of rebooking, guests can set the date of their trip at a later time.
• Rates associated with different periods of the year may apply.
• The reservation, once modified, cannot be canceled and there is no refund.

LIMITATION OF INDEMNITY

The indemnity limit for any breach by Amazon Emotions arising out of this agreement will be the return of amounts paid. Amazon Emotions will not be liable for any special, consequential, indirect, incidental or other damages arising out of or in any way related to this agreement, including lost profits.

LEGAL NOTICE AND RESPONSIBILITIES

Amazon Emotions is not responsible and will not provide any refund for portions of travel services lost due to canceled or delayed flights, weather conditions, emergencies, personal or family medical care, third-party transportation services, or any other circumstances beyond our control.

Amazon Emotions is not responsible for delay in or non-performance of any of its obligations to the extent that they relate to an event of “force majeure”. This includes, but is not limited to, cancellations and/or delays as a result of weather conditions, road conditions, fires, explosions, pandemics, droughts, floods, civil war, political instability, terrorist activities and general strikes. No refunds will be provided if a participant leaves a tour for any reason or needs to be removed from a tour.

COMPLIANCE WITH LOCAL LAWS AND LABEL

Participants must strictly comply with all Brazilian laws, respect local customs and culture, accurately assess their abilities, respect the privacy of other guests, and follow the suggestions and advice of any staff from Amazon Emotions. The decision of the Amazon Emotions manager or tour leader is final on all matters that may threaten the safety or interfere with the well-being of others.

HEALTH AND MEDICAL CARE REQUIREMENTS

Tours can be physically active, with different levels of fitness requirements depending on the specific itinerary. If any participant has a physical condition, dietary restrictions or other conditions that require special attention, this information should be sent to Amazon Emotions before the start of the trip. We reserve the right to accept, refuse or remove any participant from a trip who is deemed unable to satisfy the necessary security requirements.

IMPORTANT INFORMATION ABOUT THE STATUS OF COVID-19

At Amazon Emotion, we implement all measures necessary to ensure the safety and health of our customers and employees, in addition to provide as much flexibility as possible to let our visitors plan their trip securely. Amazon Emotions implemented security protocols at all stages of our operation as to provide a very high level of security as well as an enjoyable stay with us.

ITINERARY CHANGES

Adventure travel is inherently prone to complications and alterations. In some circumstances, it may be necessary to change accommodations, transportation, activities or other services, sometimes with little or no notice. In such cases, Amazon Emotions will make reasonable efforts to provide comparable substitutions wherever possible. Amazon Emotions will keep guests updated on any changes that may affect guests’ arrival or departure.

PHYSICAL REQUIREMENTS

Our Trips are intended for persons in good physical and mental health, with reasonably good mobility. The Physical Requirements section on each Trip page on our website provides important information regarding the physical expectations for that Trip. Please read this information carefully. Guests must meet the Physical Requirements for a Trip in order to participate, determined solely at Amazon Emotions’ discretion. Should any condition that inhibits a Guest’s ability to meet the Physical Requirements, whether physical or mental, become apparent at any point prior to or during a Trip, Amazon Emotions reserves the right to deny the Guest’s participation or continuation on a Trip, subject to the terms of Amazon Emotions’ cancellation policy. Certain Trips may require that Guest obtains medical approval before departure, and Amazon Emotions reserves the right to request additional medical information and/or a physical examination prior to or during any Trip as a condition of Guest’s participation. Special arrangements may be made for certain conditions on specific Trips only, at Amazon Emotions’ sole discretion.

DIETARY RESTRICTIONS AND ALLERGIES

Amazon Emotions can generally accommodate common dietary restrictions on all of our trips, such as vegetarian, dairy-free, gluten-free (though it may not be possible to accommodate celiac disease—please ask an Adventure Specialist for more information), though limitations on food variety may exist. However, given the nature of our trips, Amazon Emotions cannot guarantee that allergens or items on your restriction list will not be present at our camps/lodges or elsewhere during a trip. Gladly any member of our staff will be able to help explain the ingredients that make up the different dishes that are offered by Amazon Emotions. Ultimately, during expeditions you must take responsibility for your own health and safety, when trying foods that are not offered and prepared by our staff, and understand that we cannot guarantee against contamination or airborne transmission.

GUEST CONDUCT AND LIMITATIONS

Amazon Emotions operates trips in natural areas where unpredictable conditions may exist. To avoid potentially dangerous situations, both for our travelers and for wildlife, it is extremely important that all guests obey the rules and regulations set forth by the Expedition Leaders and/or local guides or other representatives of Amazon Emotions, and demonstrate reasonable consideration and respect for all staff, fellow travelers and wildlife.

VIEWING WILDLIFE

Since most Amazon Emotions trips specialize in viewing wildlife, every effort is made to arrange itineraries to places where wildlife is known to exist. However, the animals we encounter live wild and free, and we cannot fully predict nor control their movements (nor would we want to). In an attempt to locate wildlife that may have deviated from its normal movement patterns, or in the interest of traveler comfort, safety or other circumstances, we may be required to make changes to accommodations, modes of transportation, activities or other itinerary elements, sometimes with little or no notice.

Wildlife viewing may vary significantly due to numerous factors including wildlife movements and behavior, weather conditions, human interference, climate change, and changes in species biodiversity and density in the various locations visited. While Amazon Emotions makes best efforts to provide an outstanding wildlife viewing experience, we cannot guarantee that availability, diversity and/or quantity of wildlife, included what is described in our catalog, website and related imagery.

AMAZON EMOTIONS’ MARKETING MATERIALS

The images shown in our printed materials and on our website represent what our Guests have regularly seen on “typical” Trips in the past (or in the case of a new or Exploratory Trip, what our staff and researchers have previously seen). Due to weather and/or shifting wildlife conditions, some Trips may have fewer close encounters with wildlife than we normally anticipate. Also, be aware that some images in our materials are taken with a telephoto lens, and Guests should not assume that they will get very close to wildlife in such circumstances. For example, we may show a close-up shot of a monkey, viewed through a telephoto lens, but nearly all our encounters with monkeys are at a distance.

GETTING TO THE STARTING POINT OF YOUR AMAZON EMOTIONS TRIP

Amazon Emotions travelers are responsible for getting to and from the start and end points of their trip, and for arriving by the designated start time on the first day of the trip. Should guests be delayed for any reason in getting to or departing from a trip, or must leave a trip early, Amazon Emotions is not liable for any additional costs incurred in joining or leaving the trip (such as costs for accommodations or transportation), nor will guests receive a refund for any missed portion of the trip as a result of a late arrival or early departure.

AMAZON EMOTIONS’ TRAVEL DESK

Amazon Emotions’ Travel Desk does not assists Guests in purchasing international air tickets and hotel reservations. Amazon Emotions’ Travel Desk does not book flights within the United States or Canada, and cannot book flights using airline miles. For flights purchased independently, in the event of flight delays, cancellations, or any other modifications to flight schedules, Amazon Emotions is not responsible for and cannot, per airline rules, make changes to airline tickets or rebook flights and, therefore, Guests must contact the airline or booking agency directly in order to make any and all such changes themselves. Additionally, all Guests must contact the airline directly in the event of lost luggage. Guests are responsible for any and all fees or additional costs associated with flight delays, cancellations, or other modifications to flight itineraries, whether tickets were purchased through Amazon Emotions’ Travel Desk or independently. Many airline tickets are nonrefundable and have substantial change fees, which is why Amazon Emotions recommends that Guests purchase additional travel insurance to cover airfare.

LUGGAGE RESTRICTIONS

Some of our trips have enforced restrictions on luggage weight, size or type (such as hard-sided luggage). Many vehicles have limited space, and when traveling in light aircraft, overweight conditions can create a serious safety hazard, thus we adhere to strict limits on luggage weight, size and type. All restrictions on carry-on baggage include camera equipment. Guests should pack light and follow the guidelines in our pre-trip materials. Baggage exceeding specified weight, size or type limits is subject to being left behind or forwarded at your expense.

CHANGES TO AN EXPEDITION PRIOR TO DEPARTURE

AE begins planning our expeditions many months or even years in advance of departure. Occasionally, we have to make changes both before and after bookings have been confirmed. Unless otherwise provided in these Terms and Conditions, AE reserves the right to change any service prior to departure without compensation or refund; transfer packages (ground or air), group hotel nights and the voyage and itinerary itself. Such changes can be made by AE without notice and for any reason whatsoever, without allowance or refund and with extra costs, if any, being paid by the travelers.

CHANGE TO AN ITINERARY AFTER DEPARTURE

The itinerary described is subject to change after the expedition has deemed to have started at the discretion of AE. Published itineraries are suggested examples only and AE reserves the right to change the itinerary and suggested landing sites at any time during an expedition

If the expedition is interrupted, the itinerary changed or is unduly delayed or prevented from proceeding in the ordinary course by any Force Majeure Event, AE shall have the right, in its sole discretion, to terminate the expedition and to land the traveler and his baggage at any port or place at which the vessel may call at or may then be. In such event, this travel package shall be considered to have been fully performed as if the expedition were completed and the responsibility AE shall cease without any liability on the part of AE to refund any part of the fare or liability for any other costs or expenses.

In the event that AE cancels the expedition or changes the itinerary for a Force Majeure Event, the responsibility of AE shall cease upon such cancellation without any liability on the part of AE to refund any part of the price.

AE will reasonably assist participants in changing their travel arrangements and provide trip interruption letters for all participants to submit to their travel insurance providers under their trip interruption travel policy. Furthermore, included activities or excursions within a trip itinerary could conceivably be cancelled or rearranged with little or no notice as a result of factors out of our control, such as, for example, a Force Majeure Event, and no refunds will be issued for any unused activities. Any trip extensions already undertaken are not eligible for any refunds or cancellation/interruption letters.

In particular, for expeditions that do or may include Helicopter flights then we do not make refunds for helicopter time not used or for cancelled Helicopter flights whether due to a Force Majeure Event or by virtue of the decision of the Guide Leader and/or the AE staff. Also, we cannot guarantee the specific number, make and model of the helicopters used for your flight excursions, and that there will be helicopters onboard at all times or at all.

TRAVEL INSURANCE

Rates do not include travel insurance. We recommend the purchase of comprehensive travel insurance, covering trip interruption, cancellation, luggage loss, medical assistance, coverage for accidents/life, evacuation and other expenses that may arise as a result of loss, damage, injury, delay or any other inconvenience. Participants agree to assume all costs of medical care and transportation.

DOCUMENT REQUIREMENTS AND VACCINATIONS

In order to join a Amazon Emotions trip, you are responsible for obtaining and maintaining all required documents and vaccinations. These can include, but are not limited to, valid passports, visas and vaccinations. Amazon Emotions will provide details on visa and vaccination requirements in your pre-trip materials. FAMILY TRAVEL AND AGE REQUIREMENTS

Amazon Emotions welcomes families on certain trips and offers select scheduled family departures. On certain trips and most family departures, children 7 years and older are welcome. Due to safety regulations, physical limitations and concerns regarding group dynamics, we do not allow children younger than 7 on our trips. Additionally, some trips, or specific activities within a trip, have higher minimum age requirements. We strongly encourage you to call our office to speak with an Adventure Specialist about the specific requirements of the trip you’re considering so you can make an informed decision about your child’s participation. On all trips, the parents or legal guardians of children under the age of 18 must sign a Minor Permission Waiver requiring guardians to ensure that children in their care do not place themselves, other guests, staff or wildlife in harm’s way, or jeopardize the enjoyment of the trip for the group as a whole.

PERSONAL PROPERTY

Amazon Emotions is not liable for any lost, stolen or damaged personal property, including but not limited to cell phones, camera equipment, computers, tablets, luggage or personal belongings, money, credit or debit cards, personal identification documents such as passports, licenses or other travel documents, etc. We strongly recommend the purchase of travel insurance to help protect against potential loss or damage.

LANGUAGE POLICY

All Amazon Emotions Trips are conducted in English or Portuguese. Guests participating in an Amazon Emotions Trip must have a proficient understanding of the English or Portuguese language in order to fully enjoy all aspects of the Trip and, most importantly, to fully understand all rules and safety instructions provided by the Expedition Leader(s), Local Guide(s) or other individuals facilitating the Trip. Amazon Emotions is unable to provide translated pre-Trip materials or translators during the Trip. Additionally, Amazon Emotions reserves the right, in our sole discretion, to prohibit any Guest from joining or continuing on a Trip if that Guest’s language limitations pose or could pose a threat to his/her safety or enjoyment, or that of other Guests or staff, or the safety of wildlife. Should a Guest not be permitted to join a Trip or be asked to leave a Trip in progress, there will be no refund of any portion of the Trip price, used or unused, beyond that which is listed in our cancellation policy nor will Amazon Emotions be responsible for any additional expenses incurred by the Guest as a result of his/her dismissal.

FIREARM POLICY

Guests are prohibited from bringing, carrying or utilizing any type of firearm on all Amazon Emotions Trips.

ALCOHOL, PRESCRIPTION MEDICATIONS AND ILLEGAL DRUGS

Guests may enjoy alcohol in moderation on Amazon Emotions Trips. Excessive intoxication or other behaviors resulting from alcohol or other substance use, including prescription or over-the-counter medications, which pose or could pose a threat to a Guest’s safety or enjoyment, or that of other Guests or staff, or the safety of wildlife, will not be tolerated, and the Guest may not be permitted to continue on a Trip in such circumstances. The use of illegal drugs is never permitted on any Amazon Emotions Trip and is grounds for immediate dismissal from a Trip. Guests are responsible for knowing and observing the licensing and other laws for prescription medications. The use of recreational illegal substances is also never permitted on any Amazon Emotions Trip and is grounds for immediate dismissal from a Trip. Should a Guest be asked to leave a Trip in progress, there will be no refund of any portion of the Trip price, used or unused, nor will Amazon Emotions be responsible for any additional expenses incurred by the Guest as a result of his/her dismissal.

HARASSMENT POLICY

Amazon Emotions is committed to providing Trips free from any form of harassment and disrespectful or other inappropriate conduct based on sex (including pregnancy, childbirth, breastfeeding or related medical conditions), race, religion (including religious dress and grooming practices), color, gender (including gender identity and gender expression), national origin, ancestry, physical or mental disability, medical condition, marital status, registered domestic partner status, age, sexual orientation, military and veteran status or any other basis protected by federal, state or local law or ordinance or regulation.

Prohibited harassment, disrespectful or inappropriate conduct includes, but is not limited to, the following behavior:

1) verbal conduct such as epithets, derogatory jokes or comments, slurs or unwanted sexual advances, invitations, comments, posts or messages;

2) visual displays such as derogatory and/or sexually oriented posters, photography, cartoons, drawings or gestures;

3) physical conduct including assault, unwanted touching, intentionally blocking normal movement or interfering with the Trip because of sex, race or any other protected basis; and

4) threats and demands to submit to sexual requests or sexual advances.

Guests should report any harassment, disrespectful or inappropriate conduct immediately to the Expedition Leader(s). Harassment, disrespectful or inappropriate conduct may be grounds for immediate dismissal from a Trip. Should a Guest be asked to leave a Trip in progress, there will be no refund of any portion of the Trip price, used or unused, nor will Amazon Emotions be responsible for any additional expenses incurred by the Guest as a result of his/her dismissal.

PRIVACY STATEMENT

When a Guest books an Amazon Emotions Trip, Amazon Emotions will collect certain personal identifying information including but not limited to addresses, telephone numbers, email addresses, credit card information, passport information, emergency contact information and personal/medical information. All Guest information collected by Amazon Emotions is governed by our Privacy Policy. Please see the Privacy Policy page on our website for details. All health information is treated as confidential.

IMAGES RELEASE

You agree that AMAZON EMOTIONS may use, re-use and reproduce any images, photos or videos that you send to us, or that are taken by our guides and/or other travelers of you individually or in a group, in any medium, including but not limited to print, electronic media, or Internet, free of charge and without your right to inspection, for promoting and publicizing our travel products and services worldwide. If you do not want us to use any images of you that are taken by us or other participants during the tour, you must inform us or your tour leader in writing at the start of the tour.

UPDATING OF TERMS AND CONDITIONS

AMAZON EMOTIONS reserves the right to update and/or alter these terms and conditions at any time. It is your responsibility to be familiar with these terms and conditions. The latest terms and conditions can be found on the AMAZON EMOTIONS website www.tropicaltreeclimbing.com

APPLICABLE LAW AND CHOICE OF FORUM

Any dispute arising out of this agreement, including all tort claims – whether such dispute arises in contract or in tort or otherwise – shall be resolved exclusively by the state and federal courts located in Presidente Figueiredo, Amazonas. The laws of the State of Amazonas, Brazil, govern this agreement.

MERGER

This Agreement is the final, complete and exclusive statement of the parties’ agreement on the matters contained in this agreement. It supersedes all previous negotiations and agreements. I have read this entire agreement, and I am signing it freely. I understand that this is a legally binding contract. No other representations concerning the legal effect of this document have been made to me. My signature applies to all pages of this agreement.
